Her debt vs. his debt ? In TX its all COMMUNITY DEBT (for the most part). She would be protected by the bankructy laws as long as they stay married, none of the creditors could go after her for any of his discharged debts. Basically she gets the protection of the bankruptcy discharge too. If the marriage is in danger, then a joint filing would be better for BOTH parties since the non-filing spouse could find him/herself hounded by the creditors should you divorce or either of you die (dissolving the community) before the 4 year SOL expires.

Just something to consider.....
