I do not see how you are better off in a BK than you would be by defaulting and risking 1 or more judgments. If your husband's the only title owner on the car, and your home is mortgaged, I suggest you default on all of YOUR accounts and continue paying on your joint account and your husband's accounts. The creditors can't do anything to collect on a judgment from you, and if you get an answering machine and caller id, and work on paying down the joint account and his accounts and REALLY budgeting and stop charging ANYTHING except in a REAL emergency, you will likely be able to get through this. At least one of you will have been able to keep their credit in good shape. After 4 years the creditors won't be able to sue, and any judgments against you will only last 5 years in Pa.
