Thank you for your response! I really appreciate it. Long story short, an Asset Lawyer did show up. We had to reschedule due to the prior pre-trial going too long. So we are set again for the end of the month. Their claim is: it is still within the SOL for a WRITTEN contract, so they can sue me. I said the SOL for open accounts is 4 years and that open accounts are credit card accounts. Told the lawyer that I have no record of card. I want to see the signed application. The only thing he had with him is a copy of statement sent in my maiden name to an address I did not live at. Yes, Asset filed the complaint. They have the last payment in July 1998. Which I have no record of. Yesterday I received documents from them, Discovery and Interrogatories.

Yes, I answered. My question is: How can they sue based on a written contract ( application) but not have it in their possession? Any help at all would be appreciated....
