Texas (Sears) Judgement

I just want to know how to handle my situation. I moved to California from Houston, Texas in 97. Sears served me after I move here. My mother got the letter. So does that mean they never served me? Can they garnish my wages? My mother also asked them what could she do to pay them off. They yell at her and said: "This does not concern you." My mother gave them my address in California. They sent me a letter saying Sears will settle for $4000.

I have contacted the law firm twice to settle the debt. I only had $1,500, which was a tax refund. They wanted $500 extra and told me to call them back when I get the 500. I told them I work paycheck to paycheck. My mother loan me the 500. I call them back with $2000. They told me they had to contact Sears to see if they can accept this payment. I received a call from the law firm two days later. They said Sears would not accept my $2000. They will settle for no less than $2500. They told me to think about it and give them a call back. Three days past the office called me saying: “One of our representative wanted to talk with me.” I told the young lady: “I have nothing to say.” And hung up the phone.

I got tried of the tennis match they were playing with me. So, I'm now working with a credit repair agency that is trying to remove it with out me paying a dime, because I was not served properly. Is this legal or what should I do?
