I just received a summons to go to court for a judgement against me on an unpaid credit card.. My husband and I own our house and auto jointly... (both names are joined by the word "and") Can someone please tell me how a judgement works? Where is this document filed since they are only suing me and not my husband, can they put a lein on my auto or house.. I live in Florida, by the way, and we have the homestead act... If I were to sell or transfere my half of the auto to my husband, how does the judgement stop this action? I don't understand what goes on here.. Is there a lein at the automobile of registry to stop me from selling my half of the car etc.. ? Also, can they find US Government bonds, broker accounts etc...? (I don't have all those above, just asking for another person) Another quick question.. My last purchase on my credit card was January 20, 1997 stated on a March 7, 1997 statement and my last payment was January 23, 1997... I wrote a letter (cetified) to Discovery Card on March 15, 1997 stating I was disable and waiting for Social Security benefits and will no longer make any payments.. I believe the statute of limitations in Florida is four years for filing a judgment but don't know the laws on which date/activity they start from.. I received my sumons on March 22, 2001 stating they filed a case in county court for a judgement and I must answer or else I will loose this case... Their amount I own is wrong on the court document and they state they will add interest and lawyer costs which they don't state. Filed case on March 22, 2001 Last purchase Jan 20, 1997 Last payment Jan 23, 1997 Sent certified letter March 15, 1997 (making no more payments due to disability and waiting soc sec). Do I have a case here because of the statute of limitations (four years I believe in Florida)? Thanks in advance....
