First, if you are the primary cardholder on this account, then you are legally responsible for paying the card issuer for all charges on it. If the other person is *not* a co-applicant in any way and was simply an authorized user, then, as far as I know, he does *not* have any legal liability to pay the card issuer, even if he made the purchases. It sounds like you are saying that your sister wants to sue him? While it does sound like he seriously misbehaved and caused problems for your sister and you, going to court might not achieve much more than a bill from the lawyer. By giving him the card, you were legally agreeing to cover any and all charges made by him until you cancel it. Remember that the legal obligation to pay the debt is from you to the credit card issuer. The authorized user most likely did *not* sign any legal agreement to pay you or to limit his spending, so you wouldn't have grounds to sue him for violating a non-existant contract to pay. Have you contacted the credit card issuer and cancelled the authorized user card yet? If not, you should do so *immediately*. You might also want to tell them why/how the account was charged up, although you will, of course, still owe the full amount. It sounds to me like going to court would just cost more money and agravation.
