Ok, yesterday I had my 2nd meeting with my bk attorney. We have a vehicle loan with Suntrust Bank. This is a 700.00 a month payment and we will be surrendering the vehicle.

Our checking and savings accounts are also with Suntrust. I specifically asked our attorney if we needed to close these accounts due to the fact that Suntrust might try to take the car payment. I was assured that unless I gave the loan department permission to debit my account that they could not legally do so.

Today, I check my account balance and find a "Misc Debit" for 732 dollars. I call and speak to a CS Rep with Suntrust banking dept and find that yes, it is the auto loan payment + late fees. I inform them that I have been advised that they cannot legally do this without my express permission and they refer me to their loan servicing people, who are not in on the weekends.

Can they legally do this? That bad financial situation just became even worse if I cannot get this 732.00 returned to my account.
