Not trying to discredit you, just wondering out loud. Example is WhyChat's letter to answer SOL debt demands. The letter explicitly sets forth repercussions to CA's pursuing SOL debt. So how can they legally collect an SOL debt?
I agree, debt is not forgiven and surely is payable when past SOL, but 'collectable' via suit or threatening letters? Please do not take this personally, WhyChat among others kindly disabuse this unworthy scribe of false notions, genersouly imparting correct information for which I'm grateful. We have enough enemies on the other side of the tracks, we're all in the same lifeboat. Friend currently in private practice,prominent in the field did years ago represent banking industry, wrote banking law.
Their opinion is that FDCPA and FCRA are thickets into which Collectors wade when chasing non-SOL debt, riskier still when past statute. Their premise is that CA's can legally do some things, yet they continuously break all rules secure in the knowledge that consumers don't know the law and are frightened of court. Another attorney wisely counsels aspiring litigants; "No one walks out of court smiling."
Point is I'd appreciate hearing from you how CA's can legally and with no possibility of sanction pursue SOL debt. Not to rebut or discredit, rather to study their methods and devise counterstrategies and tactics.
Look, this is combat. Sometimes war is cold, sometimes it blows hot. By studying our enemy we know him as Mr. S. Tzu stated, allowing quicker and efficient nullification of his invasions of our lives. Securing personal feelings in the seabag allows debate to sharpen minds the better to rebut and discredit our common enemy. Hope this clarifies matters.
