They may file hard inquirys on a consumers CR in order to persue collection of ANY debt. Ouch, I say. UNLESS it is done with the intent of doing damage to a consumers CR. Where that line is drawn, I don't yet know. They may contact relations and associations of the debtor to gain contact information BUT may not mention that the debtor (or alleged debtor) owes money or is in debt. They can dunn via telephone. Can't speak for other states, but in California they can call "a reasonable number of times per day at reasonable hours". That translates into 3 times per day between the hours of 8am and 9pm according to a few collections attorneys that I've spoken with. As long as they don't break any titles (threaten credit, etc.) they can get as creative as they are able to persuade the debtor to pay. It's perfectly legal to make statements like... "This obligation will always follow you until you pay it off, it's up to you, I'm just here to offer you a way out for much less than the original balance of your debt." I could go on with more examples but, naw, the deal is they can bug you until you send a C&D or, if you request validation , they have to buzz off until they validate. That's a whole other novel. As long as circumstances permit, they may use ANY of the "legal" technics that ANY CA uses to persuade the debtor to make payment and/or settlement of the debt. I suppose that from a certain viewpoint, debt collection could be a very interesting profession. How would YOU persuade someone to pay an SOL debt without risking legal entanglement? As we both know, they'll step over the line whenever they think they can get away with it. That's illegal, but they do it knowing that MOST people have no idea what to do, or what their rights are.
