Illinois is not a community property state so if your husbands name is not on the accounts, they can't touch him. They will more than likely turn it over to a collection agency and then try and sue. Sears is difficult to deal with. They cannot garnish your husband's wages. You need to look at your assets and whose name is on what bill. If your name is on anything, they can try and attach it depending on what it is and how much they think that they can get from it. More than likely, they will try collections, then the judgement and once they get the judgment, they can then wait for a bit longer to collect when you get more to get.

See a lawyer if you can. Try to work it out if you can. Did you send them a hardship letter explaining your circumstances? It is worth a shot.
