Only the Federal Government can seize your tax return. However it could be added to your list of assets as far as what you have available as cash/in the bank. Once again, they will need to file a separate motion to get ahold of ANY of your assets.

Bottom line....just go to your court date. A judge will rule for or against you. Nothing will be taken. If Capital One wins it will be up to them to collect the judgement. They will probably offer you terms rather than going through the hassle of trying to collect through the court.
