"Lady" is correct, the SOL where you are SUED is the one that prevails. However, you say this was on a car loan chargeoff? Was this a repo? If so, a 4 year SOL from the date of the resale is what is in effect,PROVIDED that the repo was carried out legally and you were notified properly of the resale and given a full accounting of the deficiency. If this was not done legally, then there is NO LEGAL CLAIM for any balance due.
