I was divorced in 1985 in MI, ex was to take responsibility for cc. He and new spouse used the cards. Fastforward to 1993, I got repeated calls from Chase (who aquired the debt). I had no knowlege of this debt, and told them it was not mine. Requested proof and got statements that showed billing was to my ex and his spouse at an address I had never lived at. I wrote a note on the statements to that effect and sent back. I didn't hear from them again. Fast forward once more to last week. I recieved a letter from Asset Acceptance asking for settlement of the Chase debt. I called their 800# and left my name and number on their machine. I was called by collector who said all kinds of lies about what I had said the previous time. I once again told what happened before and demanded copies of bills. I never told him or the other collector ten years ago that this was my debt-only that it wasn't. I don't have records from ten years ago, but did send certified and 1st class letters to them yesterday stating that this is not my debt, demanding proof, and telling them not to contact me by any means except mail and then only to remove this claim or to give notice of legal action. I also told them that if they did file legal action I would invoke my rights under the SOL, as both MI and IA(where I live now) SOL's are long past.
Did I do the right thing in mentioning the SOL? Could doing that constitute an admisssion that the debt is mine? He said I should have filed a police report if someone used my account. What do you think?
