I filed for Chapter 13 bankruptcy in September 1994, and the case was discharged on June 25, 1999. One of the creditors was the IRS (unpaid taxes dating back to 1984-85). Around 1998, a tax lien was filed and appeared on all three credit reports. (I did not realize this until 2002, when I obtained my credit reports). I told both Experian and Equifax that the tax lien was "invalid" since I was under the protection of the bankruptcy courts, and they promptly removed the item from my credit file. However, TransUnion insists that it is a tax lien and, therefore, will remain in my credit file until 7 years from the date is was filed, which was 1998. I have two questions - 1. If I was under Chapter 13 bankruptcy from September 1994 to June 25, 1999, can a tax lien still be filed against me? 2. Am I correct in saying that TransUnion should remove the item, because I was under the "protection" of the bankruptcy court first, thus invalidating the filing of the tax lien ... or is TransUnion correct in leaving the item on my report because a tax lien was filed, "and that's the end of the discussion."
