The "tolling" laws on criminal offenses are a COMPLETELY different issue than in civil cases. Even in civil cases there are differences in tolling statutes between say, filing for damages in a medical malpractice case, or filing for $$ judgments in a debt case.Your lawyer's "advice" is completely mistaken, or you did not understand him/her.

SOL is an absoute defense in a lawsuit, HOWEVER, it must be raised as a defense legally, and with correct documentation, i.e. State statutes, Federal TILA definitions, etc.

The only "crap shoot" is improper preparation of your answer and affirmative defense.It is the same as if you were the victim of ID theft and were beig sued, you still have to present your case properly, or you will get "shot down" and the "crap" kicked out of you.
