The TILA law, Truth In Lending Act, will spell this out. This is federal, you can get to it from this site. WhyChat generously provided the info on this law as it clarifies and trumps state SOL statutes and the local judicial kingpins who misquote them to curry favor with the bankers.
Florida is the Killing Fields of the credit & collections 'industry', an experiment to see just how badly they can bludgeon consumers' rights before they meet resistance. They are meeting it.
Judge Cracker will tell y'all you owe da money and you gots ta pay. Bullshale. Not if it's SOL you don't and the scumbag collection agency is asking for trouble when the try collecting on SOL debt, Judge Cracker won't want to hitch his suspenders to that feces wagon of legal sanctions.
One colorful gent known as Judge Crazy blathers on and on and on about how he can't begin to know all the laws in the large books on his desk so you just better pay now or the 'sheriff will go to your house and get your stuff'. Bullshale. To see this guy in action gives you an idea of what out of control banana republics and communist dictatorships are like. This judge is either non compos mentis or he's on the pad of the collection maggots. Say little, put nothing in writing except for a clear recitation of your rights under federal law and smash these lice where it most hurt$.
When you stick a putrid wet-pants drip-nosed greaszy wig bully right where it hurts he runs away. These thugs are just like the idiots who steal 8-track players from your garage junk box. Just bright enough to be troublesome, cowardly, aversive to challenges. They just want money the easy way. When you fight them you cost them time, money, legal pain. A nice combination, that.
