Wolpoff & Abramson - MBNA - Arbitration

I too am being harrassed by W&A. My husband lost at least 10 hours of work a week beginning late last year and we were having a tough time paying our bills. We got hooked up with one debt company who screwed us and we ended up in worse trouble. We first received a letter form W&A seeking collection early this year. FYI, I am a co-signer on this account. I wrote to them asking them to validate this claim, which they, in about 30 days, responded by sending me copies of the bills. After that, I had an attorney that I work with contact W&A to find out what it would take to settle the claim. Needless to say, it was way too unreasonable. I mean, if you can't pay the bill at the normal monthly payment, then why would you ask someone to pay nearly 10 times that for a certain period of time? After that, I heard nothing from them for at least a month. At that time, I got involved with another debt company who would negotiate monthly payments with my creditors. W&A contacted my friend at work to see what the status of the account was. He told them at the time that I was about to make my first payment to this debt company and they would be negotiating a monthly payment with them. I assumed everything was honky dory until about July, when I was contacted by this company saying that they heard nothing from MBNA and they are assuming that they payments they have been sending are acceptable and will continue to make payments to them. I then contacted the debt company to see if there was anything that I could do. I was told that since the account was charged off, I could write to W&A and ask them to contact them immediately to discuss payment arrangments. I found out at the end of August (when we were served with arbitration papers) that W&A never contacted my debt counseling company. They just totally ignored my letter and went ahead and filed suit against us. I am so frustrated and very upset by this whole ordeal. MBNA has been accepting the payments that have been made since June and they go and to this to us. I was under the impression that as long as payments are being made and accepted, they could not do anything. The payments being made are about $40 less a month than the original monthly payment, so it is not a big loss. Since being served with the papers, my debt counseling company is attempting again to negotiate payments. They have been in contact with W&A and were told to send all payments to W&A instead of MBNA since they are now in control of the account. We have also answered the arbitration claim and filed with with the "forum" they used. Over the weekend we received notice from W&A that there is a certified letter waiting for us at the post office. I have been sitting and wondering what this could be this time. I am extremely upset and frustrated at this whole ordeal and W&A. W&A is supposedly negotiating a payment with my debt counseling company and they are still harrassing us! The other accounts have accepted payments from my debt counseling company and things are going fine with them. I see my balances coming down. I can also soon ask them to help us obtain a loan to pay the debts off. I am at my wits end and don't know what to do. I don't want a judgment entered against us and certainly don't want them to garnish wages, etc. I just want them to stop harrassing us and accept the payments being made until we can obtain a loan to pay them off. I just don't understand why after they have been accepting payments have they decided to do this! It this legal?
