The other side can file an objection or just let the judge make the decision. Everything but the judge's decision is usually done with written pleadings.

You need to file a motion to dimiss...some of the grounds are:

Failure to state a cause of action upon which relief can be granted.

Failure to join an indispensable party (whose interest would be affected by the outcome)

Failure of service of process..

There are others...I will have to go look them up.
