Why Chat re:BK in California

Hi Why Chat, I looked over all 3 of my CRs adated 6/5/03,6/3/03, &6/18/03 Experian shows the Wachovia account updated showing paid/never late "account closed at consumers request on record 11-2012 all other accounts in good standing. Equifax shows only 1 R9 and that is MBNA charged off last activity 4/01 It shows that First USA (which bought Wachovia) account as a R1. Now Trans Union shows First USA as account closed by consumer charged off 9/01 and they refuse to update it like the other 2 CRAs. MBNA is P&L 9/01. The last check sent was 2/2/01 but that was 6 months after no payments, so yes 8/00 would be my last "good" payment. You say it is past SOL for California but Wolpoff & Abramson are still trying to get the MBNA account paid. How do I deal with them? They have not been "bad" but I have sent them partial C&D letters stating they can only contact me via US Mail, but I do have phone machine messages left (saved) on my machine from them. Are these violations? My other question is really dealing with my current debt. I am paying back taxes and might not be able to pay this years taxes, I owe over $140K in student loans ( Iknow they don't go away with BK) and about $25K in CC debt and barely making it each month. I really do not want BK on my records but feel like I will only get ahead if I can start with out all this debt. I know it is not your place to say yes or no , but I appreciate your comments on how to better my situation. Thanks B
