Check the county court website and make sure a suit is actually pending against you. You mention a letter. Who served this and to whom? A Sheriff or process server. Make sure the 'deputy clerk' actually did sign this and that it's not some scumbag 'advanced collection technique' as taught by some wannabe barrister who still looks dumpy no matter how cheap the cut of his suit. This is after all Florida, the "Collections Killing Fields". As with the "Communist Experiment" which inflicted misery upon the Russian peoples for over seventy years, Florida is experiencing the joys of an experiment inflicted by bankers, and credit & collections 'professionals'. As Taziblue sez, if you go to court and it's small claims - under 5K - watch out for the 'mediator' at the pre-trial conference. This is still within statute, try negotiating directly with the collection lawyer. You do have good protections in this state but the swine collection lawyers, mediators are running the courts much as the inmates run the booby hatch. And yes, even good ol' boy Mr. Justice Cracker bears watching.
Who is the collection agency? I'm sensing a particular aroma from this case, and it is not a pleasant one I assure you. The stench of a little greaszy-wig maggot with an oversized mandible, the better to chomp his eighth helping at the tuna buffet. Coats the esophagus and stomach, y'see, soothes a coke-raw body. Too bad about the mind, isn't it, Mr. Palm Beach?
