Yet another run in with JBC & Assoc.

Earlier this year my husband and I refied our home loan and on my credit report was a negative rating from Merlin something or other (I think). After contacting them they said I needed to contact JBC. When I contacted JBC they said it was an NSF check from Colorado in 1997. I moved out of the state 2 months after the check was written and I have never heard anything about this check prior to then. I did tell them I intended to pay this debt- Why wouldn't I, I contacted them to settle the problem. I was awaiting information in the mail and never recieved it. Honestly, I forgot about it, and didn't think anything about it until I got a phone call from them recently. They said that my NSF check of $12 now is $132. Since I now live in Nevada they can charge a $100 fine because it past some specific point in the case. I asked when this fine incurred, and ironically it was just 2 days prior to the phone call. They had my phone number and address sinece the beginning of the year and they didn't contact me until just after this fine occurred. At this point I was upset and willing to pay and my husband took the phone away from me and started talking to them. He challenged everything they said, and they told him that if this wasn't paid by Nov 1 they would take me to court. He said go for it and the conversation was finished. He then did some research and immediately called them back telling them that they SOL was long gone but was willing to work out a realistic settlement. The rude woman on the phone said it was not negotiable and I would be taken to court if this was not taken care of in full. My husband told her it unrealistic for them so send a lawyer to Nevada from NJ for a $12 debt. She had no response to the SOL or to the challenges of actually going to court and eventually hung up on my husband. This week I sent them a certified letter requesting validation of this debt. I am so glad we never sent them any money but I do have some questions. 1) Does anyone know who Merlin or Marlin is, and can they add a negative rating to my credit without contacting me? 2)I read on a posting somewhere that the SOL can start over because I verbally agreed to pay this debt earlier this year. Is this true? 3)How far can they take this? Keep in mind I contacted them and I still have never received anything in the mail. 4) Since they did discuss this with my husband, the threats of court were through him, is it an issue they discussed it with a 3rd party. I was not married when this NSF occurred. Thank you for your opinions.
