Only a consumer can enter into bankruptcy voluntarily. The court will either rule for you or against you.

I did some more research and from what I have read, arbitration is binding and forcible if these conditions are met.

You signed an agreement pertaining to it. I don't believe that a notice of forced arbitration given after the fact is binding. There has to be a signature agreeing to it. But you need a lawyer.

Second the subject matter has to be included in the arbitration agreement. You would need to get a copy of your orginal application from the creditor (MBNA) and see what the subject matter says about arbitration.

Debt default is in a different category. You have to determine if the arbitration clause covers the subject matter of delinquent accounts.

Arbitration clauses are binding only if the subject matter is covered in the written contract and spelled out for the consumer and only if the subject matter does not contradict existing state or federal laws.

I have never heard of Homeland Financial Services. You need to get a copy of your application from your creditor. You can also file a motion to stay the proceedings. I would get a lawyer.
