If you can hold on until tomorrow, I can check for the proper form to get the case dismissed based on venue.

You might want to contact a process server in that county and have them deliver it to the courthouse for you so you know that it has been properly delivered to the court.

Also, if you are sure there is nothing in writing, that would also be basis for dismissal.

Sounds as if there are more issues here than just money.
