I went through a tough time not long ago and had a number of creditors after me yet did not want to go through the trouble and expense of bankruptcy with its 10 year credit reporting period. What I did was just tell the creditors "I am broke, can't and will not pay. Sue me or leave me alone. Don't call or I will call the police and the phone company as further contact is harrassment and I will record your calls". They all stopped calling. Two creditors, credit card firms, one a collection agency sued me. I went to our local law library and filed counter suits, cross complaints they are called in California. I sued for harrassment, invasion of privacy, infliction of intentional emotional distress, etc. I paid $100 for a book called "California causes of Action" wich even came with software with the complaints\cross complaints already prepared. I found a paralegal in the phone book who typed up the cross complaints perfectly. They cost I think $80 to file with the court. See, in the collection process the creditors with their bothering calls at work, etc. had given me reasons to sue them back. I don't know if I really could have gone through the entire trial process but I did not have to. Both creditors dismissed their cases. I am now trying to use the fact the the suits were settled to remove their postings from my credit file. I don't know yet if that part will work but I sure did get rid of the creditors. As they knew I really was "poor" it did nopt make sense for them to use a real lawyer, go to court as even if they won ...I really stil could BK and even their lawyer woud cost thousands of dollars. It works!
