First, background information.
State: VA
Judgment: less than $400.00
Date of Judgment: 4/2000

Step 1) Reviewed credit report prior to applying for a home loan. Credit report showed judgment and refers to local hospital.

Step 2) Called court, clerk stated that judgment was on record and listed the name of law office to contact. (I will be picking up copies of court documents next week.)

Step 3) Received letter from local hospital 1 year ago (still have letter, no mention of lawsuit or judgment). After attempting to find out why medical carrier (HMO) was not billed, paid bill (less than $400) by debit card (have record). (HMO refused to pay stating bill was not filed in a timely manner.)

Desired Outcome: Remove of the Judgment from credit report.

Questions:

1.) Does paying the local hospital, while having no knowledge of the judgment, constitute satisfying it?

2.) Should send the hospital a letter stating everything and see if they will have their agent (law office) remove the judgment.

3.) Should I apply the HIPAA rules concerning PHI, blocking the local hospital from sharing information with the agent (law office) concerning my healthcare information and then attempt to have the agent (law office) remove the judgment since they no longer support the reason for the original judgment?

4.) Should I attempt to have an attorney expunge the judgment? Is this allowable as the judgment is not a criminal case?

Thanks for all input,
