I had a past due credit card account from a divorce and wanted to clear it up. We made arrangements to pay a certain payoff amount and they would do a check for that amount. Well, they charged the check to the incorrect bank account which caused my to be charged an overdraft fee. When I called them back, they refused to pay the overdraft fee, even though they admitted the fault was theirs. We had agreed on a set amount for payoff and their response to my asking for reimbursement of the bounced check fee was "we already gave you a deal so we aren't reimbursing you". My point is 1: We had agreed on a set amount, not one that was fluid. 2: The mistake was on their side and they admitted it. Don't they owe me reimbursement of that bounced check fee??? They are underhandedly stealing from me, how is that legal?
