Any law professor will tell you this:


anyone can sue anybody for anything.

So, can they sue? Yes.

However, the courts do not like frivolous lawsuits, so this may just be a threat.

Also, the landlord has an obligation to mitigate damages (rent the apt) and can not just leave it empty and try to get $$$ out of you.

IN ADDITION, a major landlord is being sued now for charging tenants three months rent for terminating their leases early. This will be a major case with implications for all landlords. So, in my (non lawyer opinion) they are way out of line.

Will they sue? Go to google and type in :

"(name of your county" clerk of courts.

Go to public records and do a search by the name of this ca. That will tell you if they have sued anyone. If they have, I would go to the courthouse and read the actual files. I actually was able to use a previous case to get a landlord to settle a case which was similiar in nature.

Did you get anything in writing when you left?
Did you have a security deposit and did they keep it all?

If so, did they send you any kind of letters stating what they were doing and why?

How many months left on your lease?

Did they actually evict you, and if so did the court award any kind of money damages? If so, they would be limited to collecting that money.

If they do sue you, post again and I will help you bury them in paperwork so they will agree to reasonable settlement.
