Discover Card Bank has filed a lawsuit against me claiming that I owe them $2,500 on one credit card and $3,500 on another, plus court costs. The original credit limits on both cards was $1,000.

I answered my summons last month and went to court. I disputed the claim, so the judge told Discover´s lawyer that they needed to file a Bill of Particulars that was due by October 24, and I needed to file a Grounds of Defense by November 12.

I received the Bill or Particulars on October 24, and their case is pretty sound, in terms of my failing to pay off the card and ignoring calls and letters from them. What can I use as a Grounds of Defense, other than that I was unemployed when I graduated college, work a barely above minimum wage job now, and have no assets, other than a $500 car? By the way, I was living in NY when I applied for the cards, but I live in VA now, and I believe the cards were charged off in Fall of 2001.
