IRS and 401 k

My brother in law had a charge off from a bank. The IRS has been sending him letters. He owes $2,500. We kept telling him to call them and set up payment arrangements but he never did. Now he's afraid they'll take his 401k. Can they do that? I know they can garnish his wages and will probably have to. He has no checking account or savings other than the 401k. We're in Texas. Thank you
