Well first off they have to know where to find you. Second is is usually based upon scoring (internal, who knows how that works), anyway if you have not received anything within the past 6 months it is a sure bet that you will not be sued by them. Your best bet is to pull your credit reports (this is a private inquiry that your creditors will not see) this will give you an idea if (a) the account has been sold, (b)if it has been assigned to an agency or Attorney, etc...if the account has been sold and they have not located you, they will still need some type of certification from the original creditor (in this case Providian). And if in fact the account has been sold, in the next 6 months you may be able to dispute the Providian entry off of your credit report.
