Sears Late Charge Dispute

15 mos ago, I disputed late charge with Sears- had proof of timely payment even on their own statements! They would not take off the late charge! I told them I would not pay until they did. The next 2 statements came (still no removal) and they added 2 more late charges. I paid the 2 payments to catch up (no late charges). I have not paid since. All these arguments have been per telephone no written (my mistake). They kept sending statements and a few other written notices. They send a letter saying they were going to charge off in June (9 mos after my last payment}. Kept sending me statements until July. Got 2 letters from CA in July. Nothing since. Do I have any defense in this case? I tried to settle with them in January, but they refused. My sol is 3yrs, but have and will never have anything they can take (Totally disabled and home legally protected). Thanks for advice once again.
