I live in Kansas. there is a garnishment order against me from a judgment. However I was reading over the kansas statutes and found this listed as an exemption of garnishment in the statue 60-2310. It states " (d) Assignment of account. If any person, firm or corporation sells or assigns an account to any person or collecting agency, that person, firm or corporation or their assignees shall not have or be entitled to the benefits of wage garnishment."
My question is: the original debtor assigned this account to a collection agency, who assigned it to an attorney. The original creditor refuses to discuss this loan with me. Yet, the judgment and garnishment order are in the name of the original creditor, and not the collection agency. Does this mean that they can not garnish my wages and I can bring this up in court since it has been assigned to a collection agency? Or am I wrong on my interpretation of this. Please help if you can and thanks so much.
