The FDCPA does not define validation. IN this instance, common sense has to come into play. How would they have gotten those statements if they didn't have authority to collect? If this ends up in court, it won't be about validation but, the preponderance of the evidence and 7 years worth of back statements is pretty impressive. I know some will say anyone can print up a statement but if you try that with a judge, be prepared to prove that happened in this instance or, whoever the cc company is has a past history of doing things like this. Sorry, they've committed no FDCPA violations and they'll like win if they sue. DO you have an SOL defense?
