I have an old medical bill that was not handled correctly by the doctor's billing service and, as a result, insurance did not pay all of it. It was turned over to a CA several years ago and they are reporting it on my and DH's CRs. We weren't married at the time so DH is not responsible for it. I sent a HIPAA letter to the billing service, and included a statement that because DH and I were not married at the time of service it is a serious violation of HIPAA and FCRA to report on his CRs. Therefore, they must remove them ASAP. The billing service ignored my HIPAA letter. I am planning to send a follow-up letter but have not yet done so. DH sent a ltr to the CA requesting validation and they ignored it, but they sent him a dunning notice and verified with the CRAs when he disputed with them. DH filed complaints with the BBB and ACA. In the CA's response to BBB they deny ever receiving any validation request letters from DH. BUT, in their response to ACA they acknowledge receiving his letters and claim they sent validation to DH. Also in their response to ACA complaint they say, "On XX/XX/XX our client, XXX, received a dispute letter from Mr. Wekiva." DH has never sent a dispute letter to the doctor's billing service. I sent a HIPAA letter, and it was delivered three weeks *before* the date the CA claims their "client" received DH's dispute letter. The CA's response letter to the ACA is full of lies, so I'm wondering if their statement that the billing service received a dispute letter from DH is also a lie. But, I'm also wondering if the billing service contacted the CA after receiving my HIPAA letter. My question is, is it a HIPAA violation for the billing service to let the CA know that I sent a HIPAA letter to them without removing the account from the CA? The billing service never responded to my HIPAA letter so I was surprised to read that they told the CA about it (if, in fact, they did).
