Friday 11/14/03 I noticed that MBNA had pulled an unauthorized $250 out of my checking account on autodraft. I pay $250 every two weeks trying to do the right thing and pay off a debt as agreed to with the MBNA lawyer. When I called MBNA they told me they hadn't seen any payment since april 03 and to call Collect America who they sold the debt to. So I called, they transferred me to THEIR lawyer who was the one that said he was MBNA. I told him to cancel the autodraft and I'd do online banking. He threatened my assests, job and a lawsuit. I've paid this Collect America 2600 in the last 3 months - that's 25% of my income per month!
Well, that's it - no more for them. The question is should I pay MBNA directly. I live in alabama and I've been told the best plan is to allocate 25% of income to debts and pay poportionately to the amount of debt - if one $$ amount is half the total debt they get half the 25% of income. I'm told no judge will uphold a lawsuit if you've been paying regualarly. If worse comes to worse, garnishment in Alabama can't exceed 25% of income anyway so what more can they want?
