I’ve read this over on your web page, but I can’t find any place where it addresses this problem. I don’t know the name of the original creditor and I don’t know how to state my SOL defense. Below is the line in the SOL defense form that I don’t know how to fill out. In the area for affirmative defense, you state ; These ALLEGED debts,dated xxxx ,xxxx and xxxx from plaintiffs complaint, are time-barred under (YOUR STATE) statute § _____ Since I don’t know who the original creditor is, should I just make this a general statement? Such as:
The ALLEGED debt from plaintiffs petition, is time-barred under (YOUR STATE) statute § _____ Any advice on what to do about this would be greatly appreciated. I don’t want to fill this out improperly and lose my SOL defense. Thanks in advance, Brandon
