Help with SOL defense in Florida

My husband is being sued by FA Management Solutions on an old mastercard account. The case was filed 7/02. ACcording to all credit reports, the last activity on the account was 09/97. Hugh Shafritz claims that this is a written contract subject to the 5 years and he claims that we made a payment in January 1998. We filed a motion to dismiss based on the 4 year SOL, but the judge did not dismiss the case. How can I prove that this account is subject to the 4 year rule? I need Florida case law. Please help!!!!
