The advise you have been given, is,in my opinion.well intended, but not safe for you.

If you let them know that you know your legal rights by sending them a "validation" or a cease and desist for a NEWLY defaulted account, all they will do is say "AHA here is someone who is protecting their credit, so they are a good candidate to immediately file suit against"

As to the "arbitration" you likely signed an "arbitration agreement" with MBNA, (it is NOT valid for debt collection if you refuse arbitration), but W & A will tell you you are required to enter into it.

If this is your only debt, then you MAY be able to negotiate at some point for a payment plan,i it is NOT your only debt, you shold consider BK NOW, before all your options are drained away.

In the meantime, just respond nicely but firmly to their calls, by saying you expect to be able to work something out shortly, but that you can't right now as you are (whatever legitimate problems you have- health, job, etc.) If they start to get nasty, get an answering machine or caller ID.

If you are in a short SOL State, you MAY be able to stall them long enough to get by the dangerous time IF they think you don't know your rights.
