Cap-one/ summons to appear/ attorney/no paperwork

On Nov. 5/2002 I received a summons to appear in court regarding an account charged-off from capital one. The summons was to appear for a pre-trial conference before the judge on Dec. 5/2002. I appeared in court, signed in and was eventually called by the clerk to come to the front of court. When I went up, they told me to go outside the courtroom and wait for a cap one represenative to call me. Eventually, after about 2 hours of waiting behind about 15 other cap one charge-off customers, the rep called me and told me that she did not have any paperwork on me and that I need to go home and call the collection agency (Associated Recovery). Well, I did not call them of course.

My question is, will these facts do me any good in having this account removed from my CR? Is there a certain time frame that I need to handle this. I live in Florida and the DOLA on the account was 5/2001.
