Unfortunately...by making a payment on the account, the Statute of Limitations has been refreshed for the maximum allowable time. The good thing about Florida is simply that if the company attempting to collect is also suing the party involved...there's a stipulation process that's required prior to obtaining a judgment. That's good news is...if that time does come, I suggest you appear on the court date and let the judge hear about your financial difficulties. Judges in Florida are "consumer friendly", this means you have a better chance of coming out ahead (lower payments & interest) by going to court than to settle the account with the plaintiff's attorney. Even if they see you outside of the court room, they'll try to intimidate you into a "Consent Judgment". Meaning you're admitting to the definciency balance and agree to make negotiated payments monthly. Usually the Judge's payment arrangements will be much less than that of the attorneys offer. Also, if the company attempting to collect doesn't have all the "DOCS" necessary, there's a very good chance that the case would be dismissed WITH Prejudice. I hope this helps !!
