Providian Inquiry w/o pp

I live in Florida. Last payment on account 11/00. This account is listed on Equifax and TransUnion as closed and unrated. Already sold to Asset Acceptance. Have recieved Asset "welcome letter"! I have recieved the "Welcome Letter" from Asset Acceptance. This account is still showing on Experian as charged off and sold to another lender. My question is today on Equifax credit watch I recieved an alert. Providian did an inquiry! Does anyone know if since the debt is now sold to Asset Acceptance that Providian would have permissable purpose to do a Hard inquiry? Is there anything I can do to rid myself of this hard inquiry or anything i can write/complain to Providian?
Any help would be appreciated. Marv
