MBNA wouldn’t sue in a non wage garnishment state unless they’ve already uncovered a big fat asset that they can slap a lien on. Let me guess, you own a home with equity. They get judgment, place lien on your home. You can’t sell the home until lien is payed off.

At this stage they probably won’t settle. They’ve already made the decision. Payment in full or lien on your house. Sorry to be so harsh, but these are the realities. In the high stakes world of poker with credit card companies, you’ve got to know when to hold em and when to fold em. If you’ve got a home, unless you live in Texas, you’re gonna get sued if the debt is large enough, while your total debt is too small to consider bankruptcy.

It would be amazing for MBNA to sue unless you owned a home or property.
