If your agreement is not in writing, then you don't have an agreement. THERE IS NO SUCH THING AS A VERBAL AGREEMENT WITH A CA. Don't ever feel bad because you're not able to pay a lousy CA.
No they won't file a lawsuit. It is as Taziblue says, it just wouldn't make good business sense to go after you for such a small amount. If you need your money as you say because things are tight, then keep it until your ready to pay them. Make sure your new Written Agreement is in writing and includes deletion of their Trade Line upon payment in full or an agreed upon amount and also that they will not sell of any part of your account to another CA. or debt buyer.
