If you are sure it is beyond the SOL. Then use Why Chat's excellent letter to respond. However, I believe you were the one that wanted to take them to court. If you do, FDCPA only allows $1000.00 plus costs and attorney fees if applicable no matter how many violations. If you actually have a CA on anything violation, it would be worth your time to take them to court to collect your $1000.00 plus your costs back and the satisfaction of receiving money from a rotten CA. FCRA allows $1000.00 per violation and pays out much larger Judgments.

You may be able to get more on an out of court settlement, but if you take them to court for FDCPA violations, you will not receive anymore than $1000.00 plus your court costs and attorney fees if applicable. If you have them on 4 violations for a thousand each. Try and negotiate an out of court settlement for say $2000.00 or more if you want to try.
