If this is your debt, not being served, is not a good enough reason to have the Judgment vacated. Remember a copy of your Motion to Vacate is sent to the Plaintiff and Attorney and they will also attend the hearing in opposition to your Motion. They will tell the Judge that you owe this debt, present evidence and that they intend to serve you. Because they are both notified of the hearing date, its possible that they will be waiting until after your hearing to have you served. The Judge doesn't have to think about the Motion and he doesn't have to take it under advisement, he will act on it as you are standing in front of him.
