Yes, you can have it removed, as long as your case file shows no service. You should be aware though, that the Plaintiff, could attempt to have you served again. Do not pay this Judgment unless your court file shows you were served.

Procedure

Call the court where the Judgment was rendered and have the clerk pull your case file and check the servers return and see if you were served. If the return shows no service, then have the clerk correct the Judgment (legal term Nunc Pro Tunc) in accordance with Supreme court rule 74.06. Take a copy of your amended Judgment and send to all corresponding CRA's for immediate deletion.
