Even if this is a garnishment for a Judgment, and lets say; you wern't served and your court file shows this, you can still make the bank abide by Regulation E, and put the money back into your account until this is resolved. As Why Chat suggests, check with the court and your CR to see if a Judgment has been entered against you. Please note; a CR does not always reflect the entry of a Judgment against you. Always make the clerk pull up the servicing document within your case file and check to make sure it shows that you were served. If you havn't been served, I can show you the procedure to have it removed from your CR, or if its not listed on your CR,... from your case file. In my opinion, you will then need to file a lawsuit agaist the entity that attempted an unlawful seizure of your assets, as it is their responsibility to secure prcedures to safeguard against this problem.
