If you were not served a summons to appear in court, then you were not served with anything but a notice that they intend to garnish your bank account after they have a Judgment against you. I believe if you continue to make payments to the debt counseling service and are not late, and they still take you to court, and you show Written proof that you have an agreement with the debt counseling service, I am quite sure the Judge will void their petition and uphold your payment schedule with the counseling service. So I don't believe your question of whether they can or can't garnish your bank account will ever be an issue. Hopefully you have a Written Agreement with this debt counseling service for evidence. If you don't have a Written Agreement in place, then after obtaining a Judgment against you, they could garnish your bank account.
