I have a lawyer representing Discover Card suing me, they are trying to collect on behalf of Discover. So far I have filed an answer to the summons, requested validation, answered their interrogatories, asked for production of documents and received a court date. So far, no signed contract, I have received nothing from them at all.

Right before the court date I received a letter from the lawyer and they requested to the court for the date to be adjoured cause the discovery is not complete. Accorrding to law they have the right to do so and they cited the civil court rule.

Obviously, the lawyers do not have the signed contract or anything to prove that this account is mine. My question is what is my next step? Can I file a motion to dismiss or anything else? They have not validated the account and have not produced any type of documents and now I think they are stalling. Any help will be greatly appreciated. Thank you.
