I am and have always been in the state of Florida. In 1997, I owned a business and used credit cards for customers to pay for products. On June 3rd of 1997, the agreement was signed to process these credit cards through a third party processing company. Unfortunately, I had signed a personal guarantee. In March of 1998, I ceased doing business with my own company and I took a position with another company and I officially closed my business by the end of 1998. At the end of October or the beginning of November of 1997, a customer purchased an item. In December of 1998 there was a claim filed against me where the consumer claimed he never received the merchandise which was reflected in a letter sent to me in December of 1998 to which I promptly responded to and disputed. On November 21st, 2003, I received a summons to appear at a Pre-Trial hearing regarding this debit. Hasn’t the statute of limitations run out? Would not the credit card be treated as an open account and therefore cause the initial date of indebtedness begin 30 days after the sale? If not, when does the claim start from? In addition, wouldn’t the statute have run out anyway?
